Consumer refers to: New Zealand
Truba: referred as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Truba Limited, 451 Woodlands Road, Waihi 3682, New Zealand
Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
Provider refers to business owner of heavy machinery and heavy vehicles.
Service refers to the Website / App
Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service
Website refers to Truba, accessible from https://www.truba.co.nz
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable
Truba is an online marketplace platform that connects consumers with providers of heavy machinery and heavy vehicles. Truba is limited to connecting consumers with providers of heavy equipment only. Once consumers and providers are connected, they then enter into their own private contract with each other.
Truba charges a monthly subscription to providers only on the platform. Consumers are not charged a subscription fee. If subscription payments are not made on the due date or are dishonoured, we will aim to get in contact with you, however if this is unsuccessful then use of the service will be limited or terminated. In the event of subscription fee changes, prior notice will be given before the change.
Termination of services – if you wish to terminate your subscription with us, notification in writing via email to info@truba.co.nz is required before your next renewal date. It may take up to 3 working days to process your request. Your subscription will remain active until the end of the paid subscription period.
Users agree to comply with all applicable New Zealand laws, regulations, and codes.
All transactions and agreements are conducted at the users own risk and we are not liable for any loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from or in relation to your use of our website or service; including the quality of work carried out, personal injury or death, disputes, and claims and damages arising from the acts or omissions of any user, or breach of terms and conditions by you.
Users are responsible for their own insurances, maintenance of machinery, and health and safety processes. We are not liable for any loss, actions, expenses (including legal fees), claims and damages arising from users’ failure to have the appropriate level of insurance cover, safe and maintained equipment, and a up to date health and safety policy.
Our Terms and Conditions may be updated from time to time. You are advised to review these Terms and Conditions periodically for any changes. Changes to the Terms and Conditions will be notified on the service and are effective when they are posted on this page. By using the service, you have deemed to have accepted all terms and conditions.
Users agree they will not violate the rights of other users or violate or breach security. Any reports of illegal behaviour such as illegal, threatening, intimidating, or harassing behaviour of any user or our employees, making untrue statements about the use of the system or providers, sending spam, or misusing the system in any way will not be tolerated and will result in immediate termination of subscription and use of the service.
Disruptions of service may occur in the event of maintenance or upgrades. Notice will be given prior, where possible, to planned disruptions, however disruptions may occur suddenly and without warning.
